1. General provisions
1.1. These Terms of Use (hereinafter — Terms) govern the use of the website https://thermocomfort-store.com (hereinafter — Website). The Website is operated by Marks Fishmans (hereinafter — Seller).
1.2. By accessing or using the Website, you confirm that you have read, understood and agree to these Terms.
1.3. If you do not agree with any provision of the Terms, please discontinue use of the Website.
1.4. The Seller reserves the right to amend these Terms at any time by publishing an updated version on the Website. Continued use of the Website after changes are published constitutes acceptance of the updated Terms.

2. Use of the website
2.1. The Website is intended for consumers aged 18 or over making purchases for personal or household use.
2.2. By using the Website, you agree to:
  • provide accurate and truthful information when placing an order;
  • not use the Website for any unlawful purpose;
  • not distribute harmful, misleading or illegal content;
  • not attempt to gain unauthorised access to the Website's systems.
2.3. The Seller reserves the right to restrict access for users who violate these Terms.

3.1. The Website content — texts, images, logos, design and other materials — is the intellectual property of the Seller or its licensors and is protected by copyright law.
3.2. Reproducing, distributing or publicly displaying any Website content without the Seller's written permission is prohibited.

4. Limitation of liability
4.1. The Seller endeavours to ensure uninterrupted Website operation but does not guarantee error-free or continuous availability.
4.2. The Seller shall not be liable for losses arising from technical failures, third-party actions or force majeure.
4.3. The Seller's liability shall in no event exceed the value of the specific transaction.

  • Delivery service providers (delivery address for order fulfilment);

  • IT service providers (Website maintenance);

PURCHASE AND
RETURNS POLICY
Effective date: 1 January 2025
In accordance with EU Directive 2011/83/EU on consumer rights
and the Consumer Rights Protection Law of the Republic of Latvia
1. Ordering process
1.1. To make a purchase, select a product on the Website, add it to your cart and follow the checkout steps.
1.2. Before confirming your order, you will see a summary showing the product, price, delivery costs and total amount.
1.3. An order confirmation will be sent to your email address. The contract is formed when the Seller confirms your order.
1.4. All prices are in euros (EUR) and include VAT where applicable.

2. Payment
  • Bank transfer;
  • Payment cards (Visa, Mastercard);
  • Online banking payments (Stripe).
Payments are processed via a secure encrypted connection. The Seller does not store card details.

3. Delivery
3.1. Delivery times are stated on each product page and during checkout.
3.2. Delivery costs are included in the order total before confirmation.
3.3. Risk and ownership transfer to the Buyer when the product is delivered to the Buyer or the designated third party.

4. Right of withdrawal (14-day cooling-off period)
4.1. Under EU Directive 2011/83/EU and Latvian consumer law, you have the right to withdraw from a purchase within 14 calendar days without giving any reason.
4.2. The withdrawal period starts:
  • from the day the product is received (physical goods);
  • from the date the contract is concluded (services or digital content).
4.3. To exercise the right of withdrawal, send a clear statement to thermocomfortstore@gmail.com including: name, order number, date and the product(s) you are returning.
4.4. You may use the EU standard withdrawal form (see Appendix below).

5. Returning products
5.1. After notifying us of your withdrawal, return the product within 14 days.
5.2. Products must be returned:
  • in original or suitable packaging;
  • with all accessories included;
  • in unused, saleable condition.
5.3. Return shipping costs are borne by the Buyer unless the Seller states otherwise.
5.4. The Seller may reduce the refund if the product has been unreasonably handled or its value has diminished.

6. Refunds
6.1. The Seller will refund the full amount paid, including original delivery costs, within 14 days of receiving the withdrawal notice or the returned product (whichever is later).
6.2. The refund will be made using the same payment method used for the original purchase.

7. Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
  • Products made to the consumer's specifications or clearly personalised;
  • Products that deteriorate rapidly;
  • Sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed;
  • Digital content where download has commenced with the consumer's consent.

8. Product warranty and complaints
8.1. Statutory consumer guarantee: you are entitled to file a complaint about product non-conformity within 2 years of receiving the product (pursuant to the Consumer Rights Protection Law of Latvia).
8.2. If a product is damaged or does not match the description, please notify us immediately (no later than 2 months) at thermocomfortstore@gmail.com with the order number and photographs.
8.3. The manufacturer's commercial guarantee (if stated) supplements but does not replace your statutory rights.

9. Dispute resolution
9.1. Unresolved disputes may be submitted to the CRPC (www.ptac.gov.lv) or the EU ODR platform: https://ec.europa.eu/consumers/odr
9.2. Jurisdiction: Republic of Latvia.
